If you were hit by a vehicle while out for a stroll, you are probably owed compensation. Read on for some tips that will protect your interests and get you paid what you deserve.
1. See a doctor and do it right away.
Even minor injuries could worsen after a few days. You must be particularly mindful of head injuries, which may take more time to cause you problems. Be sure you go to the emergency room or see your doctor after an accident. If you don't, the driver of the car may allege that you are making up your injuries or that your injury did not come from the accident.
2. Be sure to call law enforcement.
They will complete an accident report at the scene. Get your own copy (if not provided with one at the scene) by contacting the agency that responded to the accident. That may the city police or the sheriff's department. This report contains nearly all the information you will need to get your case started. Provide the report to your personal injury attorney. You can expect to find the contact information for the driver and any witnesses, insurance information, and a summary of how the accident happened.
3. Don't discuss your accident with anyone that is not a close relative or your personal injury lawyer.
Avoid using social media platforms like Facebook or Twitter to post about your accident too. While the sympathy you might get will be welcome, it could damage your ability to be paid compensation. Posts on social media can be subpoenaed and used to show that:
- You are not as injured as you claimed to be.
- The accident was no big deal to you.
- You are only in it for the money.
- You may have not been paying attention when you were hit.
4. Don't talk to the insurance adjuster.
The driver's insurer will likely phone you and ask for an interview. Pedestrian victims are not required to speak to the accident adjuster for the driver. You could accidentally say the wrong thing and harm your case. Let your lawyer talk to the accident adjuster for you. On a related note, don't accept an offer to settle from the insurance adjuster for the driver either. Many accident victims are unaware of how much money they have coming to them and make the mistake of signing a release. Doing that brings the case to an end and can leave victims with no way to be paid what they actually need.
Speak to a personal injury lawyer and get the compensation you deserve from your pedestrian vs. car accident.
